Acceptance of Terms

ACCEPTANCE OF TERMS

PLEASE READ THE FOLLOWING TERMS OF SERVICE AGREEMENT CAREFULLY. BY ACCESSING OR USING OUR SITES AND OUR SERVICES, YOU HEREBY AGREE TO BE BOUND BY THE TERMS AND ALL TERMS INCORPORATED HEREIN BY REFERENCE. IT IS THE RESPONSIBILITY OF YOU, THE USER, CUSTOMER, OR PROSPECTIVE CUSTOMER TO READ THE TERMS AND CONDITIONS BEFORE PROCEEDING TO USE THIS SITE. IF YOU DO NOT
EXPRESSLY AGREE TO ALL OF THE TERMS AND CONDITIONS, THEN PLEASE DO NOT
ACCESS OR USE OUR SITES OR OUR SERVICES. THIS TERMS OF SERVICE AGREEMENT IS
EFFECTIVE AS OF 07/31/2017.

SITE USE

The user and/or member acknowledges and agrees that the Services provided and made available through our
website and applications, which may include some mobile applications and that those applications may be made
available on various social media networking sites and numerous other platforms and downloadable programs,
are the sole property of Beautiful Beginnings, LLC. At its discretion, Beautiful Beginnings, LLC may offer
additional website Services and/or products, or update, modify or revise any current content and Services, and
this Agreement shall apply to any and all additional Services and/or products and any and all updated, modified
or revised Services unless otherwise stipulated. Beautiful Beginnings, LLC does hereby reserve the right to
cancel and cease offering any of the aforementioned Services and/or products. You, as the end user and/or
member, acknowledge, accept and agree that Beautiful Beginnings, LLC shall not be held liable for any such
updates, modifications, revisions, suspensions or discontinuance of any of our Services and/or products.

DESCRIPTION OF WEBSITE SERVICES OFFERED

The Site is an e-commerce website which has the following description

Design Services, Consultation Services and Blog
Any and all visitors to our site, despite whether they are registered or not, shall be deemed as "users" of the
herein contained Services provided for the purpose of this TOS. Once an individual register's for our Services,
through the process of creating an account, the user shall then be considered a "member."

Your continued use of the Services provided, after such posting of any updates, changes, and/or modifications shall
constitute your acceptance of such updates, changes and/or modifications, and as such, frequent review of this
Agreement and any and all applicable terms and policies should be made by you to ensure you are aware of all
terms and policies currently in effect. Should you not agree to the updated, revised or modified terms, you must
stop using the provided Services forthwith.
Furthermore, the user and/or member understands, acknowledges and agrees that the Services offered shall be
provided "AS IS" and as such Beautiful Beginnings, LLC shall not assume any responsibility or obligation for
the timeliness, missed delivery, deletion and/or any failure to store user content, communication or
personalization settings.

 

Billing & Payments

DESIGN REFUNDS

At Beautiful Beginnings, LLC we want to be sure we provide you great satisfaction to your individual or business needs. All refunds will require revert of all designs created by Beautiful Beginnings, LLC. If communication is not provided to Beautiful Beginnings, LLC that the designs are no longer in use for websites, commercial, printing or advertising, we will assume that it is being used and proceed with necessary legalities. 

NO REFUNDS ON THE FOLLOWING

  1. NO REFUNDS ON ANY DEPOSITS FOR ANY SERVICE

  2. If you are unsatisfied with any design, allow Beautiful Beginnings, LLC the opportunity to make any changes.

  3. When you have approved the the final mock up design.

  4. When you have signed and approved the final design of your website.

  5. If there is no movement on the project on the client's end for five days

  6. If content has not been provided to complete the project by the deadline that Beautiful Beginnings, LLC advised of delivery. ( prior to start of final design)

  7. If there has been no communication from the client in one week after the signing of the initial contract or confirmation letter

  8. When the business advise they no longer need web design services from of Beautiful Beginnings, LLC.

  9. If the project was cancelled / voided / stopped for reasons outside of Beautiful Beginnings, LLC

  10. If Beautiful Beginnings LLC no longer wants to work with the company due to reasons that are unprofessional or illegal in regards to the client. Services will no longer be provided and no refunds will be given

CANCELLATION

6.1 In view of the nature of the service, any order – once confirmed by the Company cannot be cancelled. Cancellation of the Order by the Client will only be accepted on condition that any costs, charges and expenses already incurred, including any charges that will be levied by a sub-contractor on account of their expenses, work or cancellation conditions will be reimbursed to the Company forthwith. 

6.2 In the event the client does not provide the necessary content to complete the web design project in Beautiful Beginnings, LLC has the right to cancel the project and void the contract. Please see the refund policy above.

7) DELIVERY
7.1 The majority of services as supplied by the company are despatched electronically by email and shall be deemed as having been delivered when the email has been opened by the client.
7.2 The Company reserves the right to substitute conventional delivery methods without notice or penalty should electronic despatch prove inconvenient; in which case delivery by the Company will be deemed to have taken place when the materials are handed to the custody of the Client at his premises or to a deputed messenger or courier when posted. The Company will be entitled to charge the Client for any expenses of delivery other than normal postage charges. 

8) FORCE MAJEURE
The Company will not be liable to the Client for any loss or damage suffered by the Client as a direct result of the Company, its subcontractors or the list-owner from whom the sample or other service or material is derived being unable to perform the Contract in the way agreed by reason of cause beyond its control including Act of God, accident, war, riot, lockout, strike, flood, fire, power failure, breakdown of plant or machinery, delay in transit, postal delay, or any other unexpected or exceptional cause or circumstance.

BILLING & PAYMENT

DEFINITIONS
“Goods” means any goods and/or services provided by the Company as ordered by the Client “ Company” means Sample Answers Ltd. incorporating Prime Prospects. “ Client” means the person, firm or company placing an order with the Company. 

1) FORMATION OF CONTRACT
All Goods sold by the Company are sold subject to the Company’s standard terms and conditions (as detailed in the policy section) which form part of the Client’s contract with the Company. Terms and conditions on the Client’s order form or other similar document shall not be binding on the Company.

2) ORDERS
Orders will be deemed to have been placed when an email confirmation has been received from a responsible executive of the client company. 

3) IN HOUSE DESIGNS
BEAUTIFUL BEGINNINGS, LLC CURRENTLY CREATES ALL DESIGNS IN HOUSE NO SUB CONTRACTS

4) RISK OF LOSS
The risk of loss or damage to the Goods shall pass to the Client upon delivery of the Goods. 

5) PAYMENTS
5.1 New clients or other clients out of terms may be expected to pay in advance for their services.
5.2 All other invoices issued by the Company shall be paid by the Client within seven (7) days of the date of invoice unless otherwise agreed in writing by the Company. In the event of late payment, the Company may charge interest on the amount outstanding before and after judgement at the rate of five (5) percent from the due date until the date of payment. 
5.3 If any amount of an invoice is disputed then the Client shall inform the Company of the grounds for such dispute within seven days of delivery of the goods and shall pay to the Company the value of the invoice less the disputed amount in accordance with these payment terms. Once settlement of the dispute has been agreed, any sum then outstanding shall also be payable in accordance with these payment terms.
5.4 The Company reserves the right to increase a quoted fee in the event that the client requests a variation to the work agreed.
